LICENCE AGREEMENT
FOR THE KIM PLATFORM

PLEASE READ THIS AGREEMENT CAREFULLY. BY USING THE KIM PLATFORM, YOU AGREE TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THE AGREEMENT, YOU MAY NOT USE, COPY, REDISTRIBUTE OR MODIFY THE KIM PLATFORM.


PREAMBLE

This Licence Agreement (hereinafter referred to as "this Licence") applies to all SOFTWARE, DATABASE, and DOCUMENTATION, the assembly of all these comprising the PRODUCT, developed by, and proprietary to, Ontotext Lab ("Ontotext") (a division of Sirma Group Corp.), including, but not limited to, the KIM Platform.

This Licence constitutes a formal agreement between Ontotext and the Licencee.


PROVISIONAL DEFINITIONS

For the purposes of this Licence, the following provisional definitions are used in the Licence, including the Preamble section, as described below:

(c) Copyright Ontotext Lab, a division of Sirma Group Corp., 2008, All rights reserved. Redistribution and use in source and binary forms, with or without modification, are only permitted under the terms, conditions and provisions in this Licence.

ACCEPTANCE

By using the PRODUCT, or any part of it, you, in the capacity of a Licencee, accept and agree with all terms, conditions and provisions of this Licence, which is to be interpreted in accordance with the legislation of the United Kingdom.

ENCOURAGEMENT

Ontotext encourages the Licencee to use the SOFTWARE, the DATABASE and the DOCUMENTATION, comprising the PRODUCT, according to the conditions of this Licence. For any other uses or modifications of the PRODUCT, or of any part of it, please contact Ontotext (see the section Contact Information below).

LICENCE

  1. Subject to the provisions contained herein, Ontotext hereby grants the Licencee a Licence to use the PRODUCT free of charge for research and educational purposes. You, in the capacity of a Licencee, are NOT permitted to copy or redistribute the PRODUCT in any form without the express written permission of Ontotext. You are permitted to use the PRODUCT freely, provided that:
    1. you do not make any charge or draw any commercial benefit through the use of the PRODUCT or any part of it; and
    2. any publication, report, and/or usage of/relating to (work or results, involving) the PRODUCT, or any part of it, contains a reference to Ontotext exactly as defined in the Reference Information section in this Licence.
  2. No part of the PRODUCT constitutes open source software and it may not be used under the terms of any Licence agreements for open-source software products.
  3. Any usage of the PRODUCT requires the Licencee to obtain a registration, according to the registration procedure described at the following URL: http://www.ontotext.com/kim/KIM-registration-form.html. The Licencee may not use the PRODUCT or any part of it without, or before he/she obtains, such registration.

REFERENCE INFORMATION

Reference information to be cited verbatim, unless indicated otherwise, by the Licencee of the PRODUCT as needed, according to the terms, conditions and provisions of this Licence. Any publication, report, and/or usage of/relating to (work or results, involving) the PRODUCT, or any part of it, should refer to:
“the KIM Platform, developed by Ontotext Lab (http://www.ontotext.com/kim/)”

TITLE

All and any copyright, or other intellectual property rights used or embodied in or in connection with the PRODUCT, including all SOFTWARE, DATABASE and DOCUMENTATION, relating thereto, is and shall remain the exclusive property of Ontotext. Except as may be expressly permitted under the Copyright, Designs and Patents Act 1988 as amended by the Copyright (Computer Programs) Regulations 1992 or any other relevant national law you shall not dispose or display the PRODUCT upon the screen by use of debugging, editing, disassembling, decompiling, diagnostic or other such means for the purpose of copying the PRODUCT or any part thereof or translating it into another language. You further agree not to modify or create derivative works of the PRODUCT without an exclusive agreement with Ontotext.

DISCLAIMER OF WARRANTY

The PRODUCT is provided free of charge on an 'as is' basis. No warranty is given by Ontotext in relation to the PRODUCT or the uses to which it may be put by you, the user, or its merchantability, fitness or suitability for any particular purpose or conditions. Ontotext shall furthermore be under no obligation to provide support of any nature for the PRODUCT.

LIMIT OF LIABILITY

In no event shall Ontotext be liable for any loss or damages whatsoever or howsoever caused arising directly or indirectly in connection with this Licence, the PRODUCT, its use or otherwise except to the extent that such liability may not be lawfully excluded. Notwithstanding the generality of the foregoing, Ontotext expressly excludes liability for indirect, special, incidental or consequential loss or damage which may arise in respect of the PRODUCT or its use, or in respect of other equipment or property, or for loss of profit, business, revenue, goodwill or anticipated savings.

UNAUTHORIZED USAGE OF THE DATABASE

  1. Neither the Licencee, nor any users to whom the Licencee may have disposed or displayed the PRODUCT or any part of it, may use, modify and/or produce literal, original, imitative, derived or copied reproductions, replicas, copies or representations of any part of the DATABASE, without the exclusive prior written permission of Ontotext.
  2. The Licencee is hereby notified that Ontotext is capable of detecting quickly and easily any cases of unauthorized usage of the DATABASE, or of any part of it, via its proprietary technology and methods for detection of unauthorized usage of the DATABASE.
  3. Under the conditions of this Licence, the Licencee should be aware that any unauthorized usage of the DATABASE, or of any part of it, on his/her side, would undoubtedly effect in a serious level of incorrectness of the derived or resultant data, to the extent that the latter would become unusable.
  4. Ontotext expressly excludes liability for any loss or damage which may arise in respect of any unauthorized usage of the DATABASE, or of any part of it.

REVERSE ENGINEERING

The Licencee hereby agrees not to change or reverse-engineer the PRODUCT provided by Ontotext, without the exclusive prior written permission of Ontotext.

TERMINATION

Ontotext may terminate this Licence by instant notice if the Licencee is in breach of any term, condition or provision of this Licence. On termination, the Licencee shall pay to Ontotext all and any costs and expenses, including legal and other fees incurred in respect of the PRODUCT, this Licence or otherwise.

TERMS AND CONDITIONS RELATING TO THIRD-PARTY PRODUCTS AND LIBRARIES

Ontotext uses the following third-party technologies within the PRODUCT, as part of its proper functionality and integration:

  1. GATE – an NLP and Information Extraction platform, hereinafter referred as “GATE”. (c) Copyright The University of Sheffield.

    The GNU Library General Public License (LGPL) licence agreement for GATE is distributed along with the PRODUCT installation and is available at the following web address: http://gate.ac.uk/gate/licence.html. Text complying to the LGPL requirements follows:

    GATE is free software; you can redistribute it and/or modify it under the terms of the GNU Library General Public License as published by the Free Software Foundation; either version 2 of the License, or (at your option) any later version.   4. TouchGraph is used in the PRODUCT for the purpose of allowing a hyperbolic tree-based graph representation of the semantic repository as an alternative of the KIM Explorer, which is part of the PRODUCT. The use of TouchGraph within the PRODUCT complies with the proprietary licence agreement for Touch Graph - the Apache Software License, following verbatim at the end of this Licence. Any redistribution or modification of the PRODUCT, according to the provisions, terms and conditions of this Licence, should also conform to the terms and conditions in the Apache Software License.

  5. Lucene – an open-source Information retrieval (IR) engine, hereinafter referred as “Lucene”. (c) Copyright Apache Corporation. This PRODUCT includes software developed by the Apache Software Foundation (http://www.apache.org/). The use of Lucene within the PRODUCT complies with the proprietary licence agreement for Lucene – the Apache Software License, Version 1.1, following verbatim below. Any redistribution or modification of the PRODUCT, according to the provisions, terms and conditions of this Licence, should also conform to the terms and conditions in the Apache Software License, Version 1.1.
